When an 18-wheeler has a tire blowout, who's responsible if someone in another vehicle is injured? We ask Texas attorney Carson Runge for this AskTheLawyers™ quick question.

Carson Runge:

Well, I think you have to take that case on a specific case by case. If that blowout is caused, and oftentimes it is, because the 18-wheeler driver didn't do a proper pre-trip inspection, which they're required to do. The minimum safety rules require that a truck driver before he or she gets on the road, does a pre-trip inspection. The tires are part of that daily pre-trip inspection, and so if that blowout is caused because the tread got too low or there had been some type of debris in that tire for weeks. Then yeah. That 18-wheeler driver and the company have a duty and responsibility to make sure that their equipment is safe before they get on the road next to me, you, our families, and the people who are watching this and their families. And so I really think that tire blowouts and subsequent wrecks caused by tire blowouts and 18-wheelers have to be decided on a case by case basis.
