The first thing I would do would be send the other driver a letter, and if I knew that driver was represented by an attorney, I would send it to the attorney, asking that the other driver's cell phone information and actual cellphone be preserved so that we can inspect it and also review billing statements from the service provider and social media. So that's the first way. The second way is also through testimony of my client, if they happen to see someone looking at a phone, which frequently happens or other witnesses, and also you can do that sometimes through a video surveillance from dash cams and local businesses who may have been watching the highway or the intersection where the crash occurred.
