What happens if someone is arrested for DUI and there's a child in the car? Let's ask Austin attorney Sam Bassett for this AskTheLawyers™ Quick Question.

Even if it's your first offense, if you're arrested for DWI and you have a child present in the car, it is a felony offense. So if the state doesn't waive the enhancement, and proves those elements that you were driving while intoxicated with a child in the car, you could become a convicted felon. So it's obviously much more serious than a first DWI offense where there's no child in the car.
