Judy Maggio:

Does the prosecuting attorney represent victims who are hurt by a drunk driver? We're asking Virginia lawyer Greg Webb in this Ask the Lawyers Quick Question.

Greg Webb:

No, and that's a common misconception that people have. Prosecuting attorney's number one duties to the state or Commonwealth and is to get a conviction. Sometimes those interests and will overlap with the victim's needs and wants, but sometimes they don't. Certainly, the prosecuting attorney is not concerned with recovering the victim's medical bills or for pain and suffering and cannot do so in most places, so a personal injury attorney is necessary to recover for usually property damage and bodily injury damages including medical bills, pain and suffering, lost time from work, lost wages, things of that nature. Prosecuting attorney is not gonna be able to do that.
