Seek medical attention.

Even if the injuries sustained from a potentially defective product seem minor at first, it is important to seek medical attention for them immediately. This is twofold, as it supplies the injured party with the care they need, and also ensures that a record exists confirming the injury itself. After seeking medical attention, there are two important steps that should be taken.

First, do not send the product back.

After seeking medical attention for any injuries regardless of the severity caused by a defective product, the most important thing is to make sure to hold onto the product. If possible, leaving the product in the same condition it was when it caused the injury is also useful. If you have already returned the product or sent it to the Consumer Product Safety Commission (CPSC), ask to have it returned to you along with any packaging and instructional material that came with it.

This is all valuable evidence that could be paramount to proving the validity of your claim. Other kinds of evidence that could be useful in proving one of these cases include pictures of the product itself, damages caused by the product, injuries caused by the product, as well as any medical records confirming the existence of an injury as a result of the defective product. All of this evidence should be kept in a safe place where it cannot be lost or destroyed until an attorney can decide how to use it in the pursuit of fair compensation for your damages.

Second, consult with a product liability attorney.

The majority of product liability attorneys offer free consultations and work on contingency, which means they don’t get paid unless and until they win your case. With this in mind, it’s important to seek legal counsel from one of these attorneys if you have been injured by a defective product. Product liability can be complex and often requires expert assessment to prove that a defect does, in fact, exist, as well as what kind of defect it was and who is liable for the defect.

What might seem like user error at first could prove to be a defect in the design of the product or a failure to account for foreseeable disuse on the part of the manufacturer, both of which are legally compensable. Product liability attorneys have access to the resources necessary to analyze the product itself as well as the damages caused by it, assigning a value to both and helping further prove your case for compensation. If you or a loved one were injured by a defective product, do not wait to seek medical care, preserve the product itself and any accompanying materials, and seek trustworthy legal counsel.

The first thing that you need to do is to secure the product. Keep it. Don't send it back. The second thing is to consult with a product liability attorney.
