Medical malpractice is when those medical providers do something that falls below the bare minimum standard; something that no medical provider would reasonably do when treating a patient. A medical device failure is when someone receives usually a hardware implant, like a hip replacement or elbow replacement, and something mechanical in that device fails after it's been implanted in someone's body.
