Absolutely not. If the other driver is at fault, and in the state of Colorado, when I say at fault, the other driver has to be more than 50% at fault in causing the collision. So not only do you have a workers’ compensation claim in that scenario, you also have a claim for pain and suffering and other non-economic damages such as loss of social and recreational activities, disability, and impairment.
