Rob Rosenthal:

Is it always the truck driver's fault after an accident? And if not, who else might be responsible? We ask Utah lawyer Kevin Swenson for this AskTheLawyers™ Quick Question.

Kevin Swenson:

It's not always the truck driver that's at fault in a commercial motor vehicle crash. A lot of times they're doing what they're instructed to do. A lot of times they don't have the training they should have, or they don't have the support and the backing of the trucking company. A lot of times they have just the opposite; they're being told, “You have to go faster. You have to go further. You have to do more in a day.” That's a very tough job, and a lack of training or a lack of supervision or pushing on them by the trucking company can be a big problem. That's a problem that is system-wide, so it ends up typically being the trucking company's problem, usually not just the drivers.
