This video features Tad Thomas, a Medical Malpractice attorney based in Illinois.
Rob Rosenthal:
What's the difference between medical malpractice and a bad outcome? To find out, we ask Kentucky lawyer Tad Thomas in this AskTheLawyers™ Quick Question.
Tad Thomas:
Unfortunately, in medicine, you can have bad outcomes that aren't the result of medical negligence. In order to have a case for medical negligence, when we go to trial we have to prove that a nurse or a doctor or someone in the medical field did something that a reasonable person in their position shouldn't have done. So if it's an emergency room doctor, we have to prove that the particular emergency room doctor deviated from the standard of care, meaning that doctor did something unreasonable that most reasonable doctors would not do in the same situation.
